- Objetivos
- "The purpose of this lecture is to provide a comprehensive overview of the key issues involved in provenance research in the context of cultural property. It will also explore the significance and implications of this research for international cultural heritage law. Indeed, provenance research is an invaluable tool for addressing past cultural injustices and wrongs against individuals, groups, and communities that have been subjected to genocidal acts and legislation, colonial exploitation, and discriminatory practices. It is also crucial in combating the illicit trafficking of cultural objects, such as theft, looting, money laundering, and illegal archaeological excavations. The first part of the lecture will address the notion and methodologies of provenance research according to existing manuals and soft law guidelines. Second, it will canvas international treaty law and explain how provenance and provenance of cultural objects are framed and regulated. The lecture will then move on to discuss several practical examples and case-studies. The lecture will conclude with a discussion on the current state of provenance research as a matter of global “cultural” justice."

«The International Law Dimension of Provenance Research»
Ponente:
Andrzej Jakubowski is a lawyer and art historian affiliated with the Institute of Law Studies of the Polish Academy of Sciences in Warsaw. He holds a PhD in Law from the European University Institute in Florence and two Master’s degrees in Art History and Law from the University of Warsaw. From 2017 to 2022, he served as Chair of the International Law Association (ILA) Committee on Participation in Global Cultural Heritage Governance. Since 2024, he has been Rapporteur of the ILA Committee on Safeguarding Cultural Heritage in Armed Conflict. He serves as the vice-chair of the Cultural Heritage and the Arts Interest Group of the American Society of International Law and as the co-convener of the Interest Group on International Law of Culture of the European Society of International Law. He has authored, inter alia, State Succession in Cultural Property (Oxford University Press, 2015) and edited Cultural Rights as Collective Rights. An International Law Perspective, Brill-Nijhoff, 2016. He is the co-editor of 15 years of the UNESCO Diversity of Cultural Expressions Convention: Actors, Processes and Impact (Hart-Bloomsbury Professional, 2023), Cultural Heritage in the European Union: A Critical Inquiry into Law and Policy Brill-Nijhoff, 2019, and The 1970 UNESCO and 1995 UNIDROIT Conventions on Stolen or Illegally Transferred Cultural Property: A Commentary, Oxford University Press, 2024.
