Objetivos
Modern commercial design often involves borrowing elements from other sources. These borrowed elements may include text, drawings or photos, music, and overall “look and feel” of the site. However, to the extent these elements are protected by intellectual property rights owned by other people, such borrowing creates potential liability under various intellectual property laws.

This presentation will discuss various intellectual property issues that may arise in connection with borrowing designs for use in a commercial design. While there will be some discussion of copyright, the main focus will be other intellectual property rights such as trademark/service mark, product design and publicity rights. Sometimes, these other forms of protection overlap with copyright (for example, a logo can be protected both by copyright and by trademark). However, there are also important differences between various aspects of the various forms of protection.

The presentation will also address more practical questions that can arise in borrowing, including:
• Commercial vs. non-commercial use.
• Differences in scope of protection in various nations.
• Applicability of foreign law (overview).
• The relevance of knowledge.
• Using licenses to avoid liability.
